不久前我們剛剛報導過,美國司法部執行 WeChat 禁令的要求並未因為遞交的新證據而被加州法官 Laurel Beeler 接受。對於這一結果司法部向第九巡迴法院提出了上訴,而法院的三人法官小組在審理之後,最終還是做出了維持 Beeler 法官臨時禁止令的決定。他們判決的理由,是在上訴期間美國「並不會即刻受到無法彌補的損失」。

對於司法部來說,如果還想達到實施禁令的目的,接下來還有上訴到美國最高法院這步棋可以走。而恰恰是在今天,參議院剛剛投票通過了大法官 Amy Barrett 的提名。這位法官給外界的感覺可能相對會更偏向川普政府,司法部如果進一步上訴,結果會不會改變還真是不太好說呢。
